RENTAL TERMS AND CONDITIONS

These Master Terms & Conditions (“Terms”) apply to all vehicle rentals provided by Rank Car Rentals (“Rank Car Rentals,” “we,” “us,” or “our”).

Please read these Terms carefully before making a reservation, signing a Rental Agreement, or taking possession of a rental vehicle. These Rental Terms and Conditions, any documents signed by you or to which you have electronically consented, any documents or agreements (or links to online documents or agreements) sent to you electronically in connection with your rental, and a return record with the computed rental charges together constitute the rental agreement (collectively, “Agreement”) between you and Rank Car Rental, and any affiliate conducting business under the Rank brand

IMPORTANT — ACCEPTANCE OF THESE TERMS

BY SIGNING THE RANK CAR RENTALS RENTAL AGREEMENT, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS & CONDITIONS.

These Terms form an integral part of the Rental Agreement and apply to your rental together with any additional terms, charges, or conditions stated in the Rental Agreement.

By making a reservation, providing payment, signing the Rental Agreement, or taking possession of a rental vehicle, you agree to comply with these Terms.

A copy of these Terms is available on the Rank Car Rentals website and may be provided to the Renter before or at the time of rental.

1. DRIVER REQUIREMENTS

The minimum age to rent a vehicle from Rank Car Rentals is 25 years old. Drivers under 25 years of age may be permitted to rent a vehicle at the sole discretion of Rank Car Rentals and are subject to an additional young-driver fee of $20 per day.

All drivers must:

Only drivers authorized and listed on the Rental Agreement may operate the vehicle. The Renter is responsible for ensuring that no unauthorized person operates the rental vehicle.

2. PAYMENT & CREDIT CARD REQUIREMENTS

Payment is by credit card only.

Rank Car Rentals accepts:

The credit card used for the rental must be in the same name as the Renter named on the Rental Agreement.

The name on the credit card must match the name on the Rental Agreement and the Renter's identification. Any exception must be approved by Rank Car Rentals in advance. The Renter may be required to present the physical credit card at vehicle pickup. Debit cards, prepaid cards, cash, e-transfer, and other payment methods are not accepted unless expressly approved by Rank Car Rentals.

A valid credit card may be required for a security deposit or pre-authorization.

The Renter authorizes Rank Car Rentals, subject to applicable law, to charge the credit card for amounts properly owing under the Rental Agreement and these Terms.

Such charges may include, where applicable, rental charges, additional mileage, fuel, damage, cleaning, late return, unauthorized return, traffic or parking charges, towing, storage, recovery, applicable fees, and other amounts properly owing under the Rental Agreement.

3. RESERVATIONS & RENTAL PERIOD

Reservations are subject to vehicle availability and confirmation by Rank Car Rentals.

The rental period begins at the scheduled pickup date and time and ends when the vehicle is returned to Rank Car Rentals in accordance with the Rental Agreement.

The vehicle must be returned at the agreed date, time, and location. Late returns may result in additional rental charges. If you require additional rental time, you must obtain prior approval from Rank Car Rentals. Continuing to keep the vehicle after the agreed return time does not constitute an approved extension. Early returns do not automatically qualify for a refund.

4. CANCELLATION POLICY

Our cancellation policy is based on the scheduled pickup date and time shown on your reservation.

We recommend contacting us as soon as possible if you need to cancel or modify your reservation.

No-Show

If you do not arrive for your scheduled pickup and have not cancelled your reservation in accordance with this policy, your reservation will be considered a no-show and 100% of the total reservation amount will be charged.

Applicable cancellation and no-show charges will be charged to the credit card provided for the reservation.

Special, promotional, prepaid, corporate, or long-term reservations may have different cancellation conditions if those conditions are disclosed at the time of booking.

5. MILEAGE POLICY

Each rental includes 100 kilometers per rental day.

Any additional distance exceeding the included allowance will be charged at:

The mileage allowance is calculated based on the number of rental days specified in the Rental Agreement.

The Renter is responsible for all distance driven during the rental period, including kilometers driven by any authorized driver.

6. FUEL POLICY

The vehicle will be provided with a specified fuel level, which may be recorded at the beginning of the rental.

Standard Fuel Return

The vehicle must be returned with the same fuel level as provided at the time of pickup, unless otherwise agreed in writing.

If the vehicle is returned with less fuel than required, Rank Car Rentals will charge the cost of replacing the missing fuel together with the applicable refueling/service fee.

Prepaid Fuel Option — Skip the Gas Station

For your convenience, Rank Car Rentals offers a Prepaid Fuel Option.

Customers who purchase the Prepaid Fuel Option may return the vehicle without refueling before returning it to Rank Car Rentals.

The applicable prepaid fuel charge will be disclosed at the time of booking or rental.

Once the Prepaid Fuel Option has been purchased, no additional refueling/service fee will be charged for the remaining fuel required to bring the vehicle back to the agreed fuel level.

The Prepaid Fuel Option is a convenience service and does not provide a refund or credit for unused fuel remaining in the vehicle at return.

7. APPROVED DRIVING AREA & OUT-OF-YELLOWKNIFE TRAVEL

Rank Car Rentals vehicles are primarily authorized for use within Yellowknife, Northwest Territories, and on the Ingraham Trail for Northern Lights viewing, subject to these Terms & Conditions.

Permitted Travel

Vehicles may be driven:

Travel Outside Yellowknife & Northwest Territories

Rental vehicles are permitted to travel within N.W.T, however vehicles driven outside of Yellowknife city limits will no longer be within service range, therefore the renter is fully responsible any and all costs associated with returning the vehicle back to the location of origin. Travel to other provinces or territories, and or countries must have the appropriate insurance coverage along with written approval from Rank Car Rentals.

If you plan to take the rental vehicle outside Yellowknife and/or beyond the permitted service area, you must inform Rank Car Rentals before travelling and obtain authorization when applicable.

Written authorization is required before undertaking such travel. Approval is at the sole discretion of Rank Car Rentals and may be subject to additional conditions, restrictions, fees, or charges.

Out-of-Northwest Territories Surcharge

An additional out-of-Northwest Territories surcharge applies to vehicles authorized to travel outside Yellowknife.

The applicable surcharge will be communicated to the Renter and must be agreed to before the vehicle is taken outside the approved area.

The surcharge does not replace or waive any other applicable mileage charges, damage responsibility, insurance requirements, or other fees under the Rental Agreement and these Terms.

Unauthorized Travel

Driving a Rank Car Rentals vehicle outside Northwest Territories or any other approved area without prior written authorization constitutes unauthorized use and may result in additional charges, or termination of the rental agreement.

Unauthorized travel may also affect any applicable Loss Damage Waiver (“LDW”), insurance coverage, or other protection available under the Rental Agreement.

The Renter may be responsible for reasonable costs associated with recovering the vehicle, including towing, transportation, storage, recovery, and other related expenses, subject to applicable law.

If you are unsure whether your planned destination is permitted, please contact Rank Car Rentals before travelling.

8. INGRAHAM TRAIL & NORTHERN LIGHTS VIEWING

Rank Car Rentals permits customers to drive on the Ingraham Trail for Northern Lights viewing.

The vehicle must remain on public, maintained roads.

Off-road driving is strictly prohibited.

Customers must operate the vehicle according to current road, weather, and visibility conditions and must use reasonable care.

The Renter is responsible for determining whether conditions are reasonably safe for travel.

Damage resulting from off-road driving, prohibited road use, negligence, misuse, or operating the vehicle in unsuitable conditions may be charged to the Renter, subject to applicable law and any applicable insurance or damage waiver.

9. VEHICLE CONDITION

The vehicle is provided to the Renter in good operating condition, subject to any existing damage or condition documented at the beginning of the rental.

The Renter must inspect the vehicle before departure and notify Rank Car Rentals of any existing damage or mechanical concerns.

The Renter agrees to return the vehicle in substantially the same condition in which it was received, except for ordinary wear and tear.

The vehicle must be returned to the Rank Car Rentals location specified in the Rental Agreement, on the date and at the time specified in the Rental Agreement, unless Rank Car Rentals agrees otherwise.

Rank Car Rentals may require the vehicle to be returned earlier where reasonably necessary and permitted by law, including where the Renter breaches these Terms or the Rental Agreement.

10. WHAT YOU MAY NOT DO WITH YOUR VEHICLE

Use the Vehicle for any illegal purpose or in any illegal, fraudulent, or reckless manner, such as (i) in a race or speed contest, (ii) to tow or push anything without our prior written permission, (iii) to store or transport explosives, chemicals, corrosives, or any other hazardous materials or pollutants, (iv) by any person impaired by or under the influence of narcotics, alcohol, intoxicants, or drugs, used with or without a prescription, (v) to carry passengers in excess of the number of seat belts or outside the passenger compartment, (vi) in areas of civil unrest, including labor strike areas, (vii) without sufficient levels and types of fuel, coolants, lubricants, and other fluids, or (viii) except in an emergency, on anything other than a paved public highway or suitable graded private or public road or driveway or over bridges posted for a maximum of 3 tons (2,721.55 kilograms) or less;

Allow any of the following to operate the Vehicle: (i) any person other than you or Additional Authorized Driver (AAD)(s) without our prior written consent, (ii) anyone who has given a fictitious name, false address, false or invalid driver’s license, or who has misrepresented or withheld material facts from us in connection with the rental, (iii) anyone whose driver’s license becomes invalid during the Rental Period, or (v) anyone who has obtained the keys without our permission;

Transport goods or products for hire as a common carrier, a contract carrier or private carrier of property UNLESS (i) you obtain bodily injury and property damage liability insurance required of a motor carrier by all applicable authorities where the Vehicle is rented and operated, if different, (ii) upon our request, you provide satisfactory evidence of such insurance with us as an additional named insured and loss payee on the policy, and (iii) you and AAD(s) hold a valid class license for that purpose that complies with all applicable laws;

Modify the Vehicle or any Optional Accessories, including by removing any seats from the Vehicle

Operate the Vehicle in a manner that violates the manufacturer’s specifications and guidelines, including by loading it in excess of its Gross Vehicle Weight Rating (“GVWR”) as indicated on the driver side door jam or with an improperly or unevenly divided load;

Transfer or assign the Contract or sublease Vehicle, and any attempt to do so will be null and void.

Test the Vehicle’s technological components or capabilities

If you use the Vehicle in a prohibited manner or violate any other provision of the Contract, we may immediately terminate your right to use the Vehicle without any further notice to you or AAD(s). In that case, we would have the right to seize the Vehicle without legal process or notice to you or AAD(s). We would also retain all of our other rights or remedies provided by law. By entering into the Contract, you and AAD(s) waive all claims for damages connected with our seizure, including loss or damage to contents or cargo, and shall pay all expenses we incur in returning the Vehicle to the Return Location.

If you or AAD(s) continue to operate the Vehicle after we have terminated your right to do so, we may notify police the Vehicle has been stolen. By entering into the Contract, you and AAD(s) agree to release and discharge us from and indemnify, defend and hold us harmless against any liability arising from such notice. You also remain responsible for all charges, costs, taxes, fees, and obligations.

11. UNAUTHORIZED RETURN LOCATION

The vehicle must be returned to the authorized return location specified in the Rental Agreement unless Rank Car Rentals has approved a different return location in advance.

If the vehicle is returned to an unauthorized location, the Renter may be responsible for:

Any applicable charge will be subject to applicable law.

The Renter remains responsible for the vehicle until it has been properly returned or recovered by Rank Car Rentals.

12. DAMAGE, LOSS & RENTER RESPONSIBILITY

Subject to applicable law and any applicable Loss Damage Waiver, the Renter is responsible for loss of or damage to the vehicle occurring during the rental period.

This may include damage resulting from:

Where permitted by law, the Renter may also be responsible for reasonable expenses arising from the loss or damage.

13. TOTAL LOSS

If the rental vehicle is declared a total loss, the Renter may be responsible, subject to applicable law and any applicable Loss Damage Waiver, for the reasonable replacement value of the vehicle together with applicable expenses arising from the loss.

Any responsibility for total loss will be determined in accordance with applicable law, the Rental Agreement, applicable insurance arrangements, and any protection purchased by the Renter.

14. TOWING, STORAGE, IMPOUND & RECOVERY COSTS

Subject to applicable law, the Renter may be responsible for reasonable costs resulting from the loss, damage, unauthorized use, or recovery of the vehicle, including:

These costs may apply in addition to damage charges.

15. LOSS OF USE

If the vehicle is damaged or otherwise taken out of service as a result of an incident for which the Renter is responsible, the Renter may be responsible, subject to applicable law and any applicable protection, for reasonable loss-of-use charges.

Loss of use may be calculated based on the number of days the vehicle is unavailable for rental multiplied by the applicable daily rental rate stated in the Rental Agreement.

16. DIMINISHED VALUE

Where permitted by applicable law, Rank Car Rentals may seek reasonable compensation for a reduction in the vehicle's market value resulting from damage occurring during the rental period.

Any diminished-value claim will be assessed based on the circumstances of the damage, the vehicle's condition, applicable valuation evidence, and applicable law.

17. DAMAGE CLAIMS ADMINISTRATION FEE

Where permitted by applicable law, Rank Car Rentals may charge a reasonable damage claims administration fee to cover the administrative costs associated with assessing, documenting, processing, and managing a damage claim.

18. LOSS DAMAGE WAIVER (LDW)

Rank Car Rentals offer a Loss Damage Waiver (“LDW”) as an optional protection product. With LDW avoid paying for damage to our vehicle with limited out of pocket expense and no increase to your personal policy due to an incident.

In the event that the Renter is unable to provide proof of insurance, they are required to purchase LDW through Rank Car Rentals

If the Renter purchases Loss Damage Waiver (LDW), Rank Car Rentals’ LDW will reduce the Renter’s financial responsibility for certain loss or damage to the rental vehicle, subjectto the terms, conditions, exclusions, and applicable deductible outlined below.

The deductible for Rank Car Rentals is $2,500

LDW does not necessarily cover all losses or charges.

Unless specifically stated otherwise, LDW does not cover:

19. WHEN DAMAGE WAIVER DOES NOT APPLY

Any Loss Damage Waiver may be void or unavailable where the Renter or an authorized driver breaches the Rental Agreement or these Terms.

This may include circumstances where the Renter or driver:

Where a waiver does not apply, the Renter may remain responsible for the applicable loss or damage, subject to applicable law.

20. VEHICLE TRACKING & SECURITY

Rank Car Rentals vehicles may be equipped with GPS, telematics, remote tracking, security, or other vehicle-monitoring technology.

To the extent permitted by applicable law, Rank Car Rentals may use such technology to:

Information collected through vehicle-monitoring technology will be handled in accordance with applicable privacy laws and Rank Car Rentals' privacy practices.

21. VEHICLE RECOVERY & REMOTE DISABLING

Where permitted by applicable law, Rank Car Rentals may take reasonable steps to recover a vehicle if it is:

Where legally permitted and technically available, Rank Car Rentals may use remote vehicle technology to assist with locating, securing, disabling, or recovering a vehicle.

The Renter may be responsible for reasonable recovery costs resulting from a breach of the Rental Agreement or these Terms, subject to applicable law.

22. ACCIDENTS, COLLISIONS & DAMAGE REPORTING

If an accident, collision, theft, vandalism, or other incident occurs involving the rental vehicle, you must:

Do not abandon the vehicle or arrange significant repairs without contacting Rank Car Rentals, except where immediate action is reasonably necessary for safety.

Failure to properly report an accident or cooperate with a lawful investigation may affect any applicable damage waiver or protection.

23. WINTER & NORTHERN DRIVING

Driving in Yellowknife and the surrounding area can involve challenging Northern conditions, including:

Renters must drive according to conditions, maintain a safe speed, follow applicable traffic laws, and exercise reasonable caution.

All road closures and travel restrictions must be followed.

Rank Car Rentals does not guarantee that weather or road conditions will be suitable for a particular trip or destination.

Winter Driving Instructions

During the winter months, a Winter Driving Instruction Sheet is provided in the glove compartment of each Rank Car Rentals vehicle.

The Winter Driving Instruction Sheet contains important information and recommendations regarding the safe operation of the vehicle in winter conditions, including driving on snow and ice, cold-weather precautions, vehicle operation, and other Northern driving considerations.

Renters are strongly encouraged to review the Winter Driving Instruction Sheet before operating the vehicle.

The Renter is responsible for operating the vehicle safely and appropriately for the prevailing weather and road conditions and must comply with all applicable traffic laws and safety requirements.

The Winter Driving Instruction Sheet is provided as a safety resource and does not replace the Renter's responsibility to exercise reasonable care or comply with applicable laws and these Terms & Conditions.

24. PETS & ANIMALS

PETS AND ANIMALS ARE NOT PERMITTED IN RANK CAR RENTALS VEHICLES.

If an unauthorized pet or animal is transported inside a rental vehicle, a $1,200 pet fee will be charged to the Renter's credit card.

This fee covers additional cleaning, detailing, deodorizing, and remediation required as a result of unauthorized pet or animal use.

If additional damage or loss occurs, the Renter may also be responsible for the reasonable cost of repairing or replacing damaged property, subject to applicable law.

This restriction does not limit any rights relating to service animals or other legally protected accommodations.

25. SMOKING & VAPING

SMOKING AND VAPING ARE STRICTLY PROHIBITED INSIDE ALL RANK CAR RENTALS VEHICLES.

We maintain a 100% smoke-free fleet. No one may smoke or vape any substance inside or immediately surrounding the Vehicle. The Renter may be charged reasonable cleaning, detailing, deodorizing, or remediation costs if the vehicle is returned with smoke, cannabis, vaping, or other persistent odours or contamination.

26. PROHIBITED USE

Rental vehicles must be operated safely, responsibly, and in accordance with applicable law.

27. BREAKDOWN & ROADSIDE ASSISTANCE

If the vehicle develops a mechanical problem or becomes disabled, contact Rank Car Rentals as soon as reasonably possible.

Do not arrange significant repairs or towing without prior authorization, except where immediate action is reasonably necessary for safety.

Where a breakdown, towing, recovery, or immobilization results from misuse, negligence, prohibited road use, or violation of these Terms, the Renter may be responsible for reasonable associated costs, subject to applicable law.

28. LOST KEYS & EQUIPMENT

The Renter is responsible for reasonable replacement costs for lost, stolen, or damaged:

29. TRAFFIC & PARKING VIOLATIONS

The Renter is responsible for all parking tickets, traffic violations, fines, penalties, impound charges, and other government charges resulting from the Renter's use of the vehicle.

Where permitted by law, Rank Car Rentals may charge a reasonable administrative fee for processing such matters.

30. VEHICLE SECURITY

The Renter must take reasonable precautions to protect the vehicle from theft, vandalism, and damage.

The vehicle must be locked when unattended. Keys must not be left inside an unattended vehicle. The Renter must not leave the vehicle running and unattended except where reasonably necessary for safety and permitted by law.

31. RETURN OF VEHICLE

The vehicle must be returned:

The Renter remains responsible for the vehicle until it has been returned in accordance with Rank Car Rentals' instructions.

If you wish to return the Vehicle at a location other than the Designated Return Location, you must contact us prior to the Designated Return Time. We may, in our sole discretion, deny permission to return the Vehicle to an alternative location. If we grant permission to return the Vehicle to an alternative location, we may apply different rates and additional fees or charges, which could increase the cost paid by you.

31.1 If You Fail to Return the Vehicle.

If you fail to return the Vehicle at the Designated Return Time and to the Designated Return Location, subject to any approved extensions or modifications described in Paragraph 31, you will breach this Agreement. We may, at our discretion and subject to any notice requirements imposed by Applicable Law, treat your failure to return the Vehicle according to the terms of this Agreement as a theft or other illegal taking. You may be charged for any fees associated with the failure to return the Vehicle, in addition to the daily charges and other fees and changes described in this Agreement, and you agree that we may collect any such charges by charging the Payment Card you provided to us. Any payment by the payment card does not constitute a waiver of our right to treat the Vehicle as stolen.

32. CLEANING CHARGES

Vehicles must be returned reasonably clean.

Additional cleaning charges may apply where the vehicle requires excessive cleaning because of:

The $1,200 unauthorized pet fee applies separately where applicable.

33. COMPANY'S RIGHT TO TERMINATE A RENTAL

Rank Car Rentals may terminate a rental and require the immediate return of the vehicle where permitted by law if the Renter:

34. EXTREME WEATHER & ROAD CLOSURES

Rank Car Rentals is not responsible for delays, cancellations, road closures, severe weather, wildfire, evacuation orders, government restrictions, or other circumstances beyond our reasonable control.

We will make reasonable efforts to assist customers affected by such circumstances, subject to safety, vehicle availability, road conditions, and other circumstances.

35. PRIVACY & PROTECTION OF PERSONAL INFORMATION

Rank Car Rentals is committed to protecting the privacy, confidentiality, and security of personal information and credit card information collected from customers.

Rank Car Rentals will handle personal information in accordance with applicable privacy laws of the Northwest Territories and Canada, as applicable.

This section describes how Rank Car Rentals may collect, use, retain, protect, and disclose personal information and payment information in connection with its vehicle rental services.

35.1 Collection of Personal Information

Rank Car Rentals may collect personal information and payment information that is reasonably necessary to provide and administer vehicle rental services.

Information collected may include, where applicable:

35.1.1 Lawful Collection

Rank Car Rentals will collect personal information only for purposes that are reasonably connected with its business operations and the provision, administration, protection, and enforcement of its vehicle rental services, subject to applicable law.

35.1.2 Information Collected Directly from the Customer

Where reasonably practicable, personal information will be collected directly from the customer.

Information may be collected through reservation forms, rental agreements, online booking systems, email, telephone, in-person interactions, payment processors, and other secure or reliable means.

Where consent is required by applicable law, Rank Car Rentals will obtain the customer's consent before collecting, using, or disclosing personal information for the applicable purpose.

35.1.3 Limiting Collection

Rank Car Rentals will make reasonable efforts to limit the collection of personal information to information that is necessary or reasonably required for the purposes for which it is collected.

Rank Car Rentals will not knowingly collect more personal information than is reasonably necessary for the applicable business or legal purpose.

35.2 Purposes for Collecting Personal Information

Rank Car Rentals may collect, use, and retain personal information for purposes including:

Personal information collected by Rank Car Rentals will be used for the purposes for which it was collected, for reasonably related purposes, or for other purposes permitted or required by applicable law.

Rank Car Rentals will not knowingly use personal information for an unrelated purpose without obtaining any consent required by applicable law.

Where permitted or required by law, Rank Car Rentals may use or disclose personal information without consent, including where necessary to comply with a legal obligation, court order, lawful investigation, or other legal requirement.

35.4 Credit Card & Payment Information

Rank Car Rentals takes reasonable measures to protect credit card and payment information.

Credit card information may be collected and used for purposes including:

Rank Car Rentals may use third-party payment processors or financial institutions to process credit card transactions.

Rank Car Rentals does not require or intend for customers to provide complete credit card information through unsecured email or other insecure communication methods.

Customers should not send full credit card numbers, security codes, or other sensitive payment information through unsecured communications unless specifically instructed to do so through an approved secure process.

35.5 Accuracy of Personal Information

Rank Car Rentals will make reasonable efforts to ensure that personal information in its custody or control is accurate, complete, and current to the extent necessary for the purposes for which it is being used.

Customers should notify Rank Car Rentals if their personal information changes or if they believe information held by Rank Car Rentals is inaccurate or incomplete.

35.6 Protection & Security

Rank Car Rentals will take reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of the information to protect personal information and payment information against unauthorized access, collection, use, disclosure, copying, modification, loss, theft, or destruction.

Access to personal information will be limited to individuals who reasonably require access for legitimate business, operational, legal, or administrative purposes.

No method of electronic storage or transmission can be guaranteed to be completely secure. Rank Car Rentals will nevertheless take reasonable measures to protect information in its possession or control.

35.7 Disclosure of Personal Information

Rank Car Rentals may disclose personal information where reasonably necessary to provide or administer rental services or where permitted or required by applicable law.

Depending on the circumstances, information may be disclosed to:

35.8 Vehicle Tracking & Telematics Information

Rank Car Rentals vehicles may contain GPS, telematics, vehicle-location, or other security and monitoring technology.

Information collected through these systems may include vehicle location, mileage, vehicle status, driving-related information, or other information generated by the vehicle or its systems.

Subject to applicable law, this information may be used to:

35.9 Retention of Personal Information

Rank Car Rentals will retain personal information only for as long as reasonably necessary for the purposes for which it was collected, to administer the customer relationship, to resolve disputes, to maintain business and accounting records, to comply with legal obligations, or for other purposes permitted by applicable law.

When personal information is no longer reasonably required, Rank Car Rentals will take reasonable steps to securely dispose of, destroy, or anonymize the information, subject to applicable legal and business record-retention requirements.

35.10 Customer Access & Correction

Subject to applicable law and any applicable exceptions, customers may request access to personal information held by Rank Car Rentals about them.

Customers may also request correction of personal information that they believe is inaccurate or incomplete.

Requests for access or correction should be directed to Rank Car Rentals using the contact information provided at the end of these Terms.

Rank Car Rentals may require sufficient information to verify the identity of the person making an access or correction request.

35.11 Privacy Concerns & Complaints

Customers who have questions or concerns regarding the collection, use, disclosure, or protection of their personal information should contact Rank Car Rentals.

Rank Car Rentals will make reasonable efforts to review and respond to privacy concerns in accordance with applicable privacy requirements.

Where applicable, customers may also have the right to make a complaint to the appropriate privacy oversight authority in the Northwest Territories or Canada.

35.12 Consent

Where consent is required by applicable law, the customer consents to the collection, use, and disclosure of personal information for the purposes described in these Terms and the Rental Agreement.

Where permitted by law, a customer's decision not to provide information that is reasonably necessary to administer the rental may prevent Rank Car Rentals from being able to provide certain rental services.

By signing the Rental Agreement, the Renter acknowledges that they have been provided with or made aware of these Terms & Conditions, including the privacy provisions contained herein.

35.13 Changes to Privacy Practices

Rank Car Rentals may update its privacy practices or this section from time to time to reflect changes in its business practices, technology, legal requirements, or applicable privacy legislation.

The current version of these Terms will be made available on the Rank Car Rentals website.

36. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Rank Car Rentals is not responsible for indirect or consequential losses arising from a rental, including missed travel arrangements, accommodation costs, loss of income, or other consequential expenses.

Nothing in these Terms excludes or limits liability that cannot legally be excluded.

37. GOVERNING LAW

These Terms are governed by the laws applicable in the Northwest Territories and Canada.

Any provision found to be invalid or unenforceable will be limited or removed to the extent necessary, while the remaining provisions will continue in effect.

Nothing in these Terms is intended to limit any rights or remedies that cannot legally be excluded.

38. CHANGES TO THESE TERMS

Rank Car Rentals may update these Terms from time to time.

The Terms applicable to a rental will generally be the Terms in effect and provided to the Renter at the time of the reservation or rental, unless otherwise required by law or agreed in writing.

The current version of these Terms will be made available on the Rank Car Rentals website.

39. ACCEPTANCE OF TERMS

BY SIGNING THE RANK CAR RENTALS RENTAL AGREEMENT, THE RENTER CONFIRMS THAT THEY HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS & CONDITIONS.

These Terms are incorporated into and form part of the Rental Agreement.

The Renter's signature on the Rental Agreement constitutes the Renter's acknowledgement and acceptance of these Terms & Conditions.

The Renter acknowledges that these Terms are available on the Rank Car Rentals website and may be provided to the Renter before or at the time of rental.
